It is necessary to have good features of buildings, and the judicial affairs must be fair and quick, said Chairman of the State Administration Council Prime Minister Senior General Min Aung Hlaing at the opening ceremonies of the Advocate-General Office of Mandalay Region and the High Court of Mandalay Region separately in Chanmyathazi Township yesterday morning.
The Senior General pressed the button to unveil the signboard of the Advocate-General Office of Mandalay Region and viewed around the building of the region Advocate-General Office.
The Senior General attended the opening ceremony of the High Court of Mandalay Region and unveiled the signboard of the High Court of the region. The Senior General and party visited the High Court building.
Speaking on the occasion, the Senior General said that the State Administration Council is taking over the State responsibilities under the Constitution. Some laws and rules not in conformity with the current era were amended, revoked, substituted and drawn as new ones. The budget is allocated for the construction of new court buildings and new law offices.
Myanmar’s judicial system is based on the common law system of the British. According to the Constitution (2008), judicial power is one of the three powers of the State. The Supreme Court of the Union is the highest court in the State. Region and state high courts, district courts, courts of self-administered zones and division, and township courts are formed under the Supreme Court of the Union.
The Ministry of Legal Affairs plays a key role in the Union government. The Union Attorney-General is responsible for the Head of State and region and state advocate-generals are also responsible for the Head of State via the Chief Ministers. Before the British colonialized Myanmar, the Myanmar society used the Myanmar traditional judicial system based on the customs of the society. In the monarchical era, the king ruling the country was the highest authority of the judicial sector. The judicial power descended from the king to the queen, crown prince, royal families, court counsellors, judges appointed by the king, town governors, heads of town and heads of villages respectively. The legal sources exercised by Myanmar kings were codes, codes of laws and judgements. British colonized Myanmar after three aggressive wars and substituted Myanmar traditional judicial system with the common law system.
Prompt and free judgements without any corruption under the law plays a key role. The quickest judicial measure will directly benefit the most correct judgement. Hence, the Legal Aid in Criminal Justice Systems was formed for quickly handling the cases. The group comprises officials from the Supreme Court of the Union and the Legal Affairs Ministry.
It is necessary to have good features of buildings, and the judicial affairs must be fair and quick. It aims to accredit the process of executive, legislative and judicial sectors in Myanmar. Qualified judicial officers and law officers must be appointed and deployed. Opportunities must be created for law graduates, master of law graduates, doctoral law graduates from various universities to have workplace experiences. It can turn out the qualified higher-grade pleaders, advocates, legal consultants and law experts with the aim of becoming a country to apply correct judicial system without corruption.
In building a genuine disciplined democracy all the citizens aspire a democratic country, it is necessary to abide by the human rights which is basic for democratization. All the people need to consider the protection, uplifting and contributing to the restoration of peace, socio-economic development, and human rights based on the rule of law.
All are to cooperate with one another to handle the unnecessary delay of civil cases, criminal cases, appellate and amendment must be undertaken in a short time. As efforts are being made to emerge the Union based on multiparty democracy in accord with the wish of the people, law officers and judicial officials need to handle the cases in their respective areas.
Then, the Chief Justice of the Union expressed thanks for the opening of the grand High Court of Mandalay Region. Officials need to take responsibility for the maintenance of existence beautifying tasks of the high court and security. Officials discussed further maintenance of the buildings.
The Prime Minister also inspected the Yadanabon Garden being built by the Mandalay City Development Committee near the moat.
The chief minister and the mayor reported on the implementation of the garden project and plans to open the garden phase by phase for public relaxation. The Senior General instructed officials to build the recreation centres and ways for the garden to implement the project meeting international standards and carry out maintenance for the long run.
The Senior General and party viewed the progress of construction tasks and future plans and attended to the needs. —MNA
